These Terms & Conditions ("Terms") govern your access to and use of inkoracle.ai and any related services (the "Service") operated by Ink Oracle™ ("we", "us", or "our"). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

You must be at least 16 years old to use the Service. By using the Service you represent that you meet this requirement and that the information you provide is accurate.

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

Ink Oracle™ generates personalized readings and tattoo concepts using AI. Outputs are creative interpretations intended for inspiration only. The Service is not a substitute for advice or work performed by a licensed tattoo artist, medical professional, mental-health professional, or legal advisor.

You agree not to:

• Use the Service for unlawful, harmful, hateful, or harassing purposes.
• Submit content depicting minors in a sexual context, real persons without their consent, or content that infringes intellectual property or privacy rights.
• Attempt to reverse-engineer, scrape, overload, or interfere with the Service or its underlying infrastructure.
• Resell, sublicense, or commercially exploit the Service without our written consent.
• Bypass authentication, rate limits, or other technical restrictions.

You retain ownership of the answers, prompts, and reference images you submit ("User Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display your User Content solely to operate and improve the Service. You represent that you have all rights necessary to submit your User Content.

Subject to your compliance with these Terms, we assign to you the rights we hold in the readings and concept images produced for your account, for personal and commercial use, including taking them to a tattoo artist. AI-generated output may not be eligible for copyright in every jurisdiction, and similar outputs may be produced for other users. We make no warranty of uniqueness.

The Service, including its design, software, text, logos, and the Ink Oracle™ trademark, is owned by us or our licensors and is protected by intellectual property laws. No rights are granted except as expressly stated in these Terms.

The Service relies on third-party providers (hosting, authentication, and AI models). Their availability and terms may affect your experience. We are not responsible for the acts or omissions of third parties.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. ANY DECISION TO GET A TATTOO IS YOURS ALONE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL ARISING OUT OF OR RELATED TO THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $50.

You agree to defend, indemnify, and hold harmless Ink Oracle™ and its officers, employees, and agents from any claim or demand arising out of your use of the Service, your User Content, or your violation of these Terms or applicable law.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. Sections that by their nature should survive termination will survive.

We may modify the Service or these Terms at any time. Material changes will be announced on the Service. Continued use after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the jurisdiction in which Ink Oracle™ is established, without regard to its conflict-of-laws rules. The courts of that jurisdiction will have exclusive jurisdiction over any dispute, except where applicable consumer-protection laws give you the right to bring proceedings in your country of residence.
